ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the the third respondent to consider and pass order on the petitioner's representation and grant permission to make peaceful worship Sri Muthu Vinayagar Temple Festival at Poosanikalam, Nerkuppai, Thirruppathur Taluk, Sivagangai District, dated 11.02.2026.

2.Admittedly, there are several litigations pending between the petitioner and the fourth respondent. The petitioner and the fourth respondent belong to the same community and the same faction.

However, disputes arose between them, which culminated in the litigation in W.P.(MD) Nos. 24758 and 25041 of 2023. This Court, vide order dated 16.10.2023, recognized that the fourth respondent had carried out the Kumbabishekam. The petitioner, having lost the said case, filed another writ petition in W.P.(MD) Nos. 14249 of 2025 and 4905 of 2022, and this Court, by order dated 11.06.2025, granted permission to conduct the Varudabhishekam. Now, the petitioner seeks only the right to worship in the temple.

3.The learned counsel appearing for the fourth respondent submitted that he has no objection to the petitioner offering worship. However, the petitioner shall not interfere in the administration of the temple or claim any administrative right.

4.Recording the submission made by the learned counsel appearing for the fourth respondent, the petitioner is permitted to offer worship in the temple, without creating any disturbance or claiming any other right. In the event of any festival being conducted by the fourth respondent, the fourth respondent is directed to permit the petitioner to participate in the same.

5.With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs.
