O R D E R

This writ petition has been filed seeking a direction to the second and third respondents to open the mosque for conducting daily prayers and other religious activities, by considering the petitioner’s representation dated 13.02.2026.

2. Mr.K.Jeyamohan, learned counsel, takes notice for Respondent Nos.1 to 3 and Mr.S.Shanmugavel, learned Additional Government Pleader, takes notice for the fourth respondent. Since no adverse order is going to be passed against the fifth respondent, notice to the fifth respondent is dispensed with.

3. It is the case of the petitioner that he is the President of Masjid Thowheed Pallivasal, Kovilpatti Administrative Committee. According to the petitioner, in the year 2009, he along with other residents of the Kovilpatti area established Masjid Thowheed and constructed the mosque. It is further stated that the fourth respondent attempted to occupy the mosque. In the meantime, on 08.05.2019, the third respondent allegedly came to the mosque and placed an additional lock over the existing lock, thereby locking the mosque without issuing any prior notice or affording an opportunity to the petitioner or the committee. In order to resolve the issue, the petitioner submitted a written request on 30.11.2019 to the first respondent seeking registration of the mosque in the list of Waqf institutions. It is also stated that on 28.11.2019, the petitioner made an application before the second respondent, along with the prescribed fee, requesting necessary action for registration of the mosque before the first respondent. However, no action has been taken by the respondents so far. Thereafter, the petitioner submitted a detailed representation dated 13.02.2026 to the second respondent. Since the said representation has not been considered, the present writ petition has been filed.

4. The learned counsel appearing for respondent Nos.1 to 3 submitted that the representation of the petitioner dated 13.02.2026 would be considered in accordance with law.

5. In view of the above submission, without expressing any opinion on the merits of the matter, this Court directs the first respondent to consider the petitioner’s representation dated 13.02.2026 and pass appropriate orders on merits and in accordance with law, within a period of one week from the date of receipt of a copy of this order. The first respondent is further directed to ensure that no law and order problem arises while considering the petitioner’s request.

6. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
