This Writ of Habeas Corpus Petition has been filed seeking a direction to the second respondent-Police to produce the petitioner’s husband M.Harikrishnan, aged about 94 years, before this Court and set him at liberty.

2. Heard both sides and perused the materials available on record.

3. It is seen from the records that the petitioner’s husband has been missing since 28.12.2013, pursuant to which, she lodged a complaint with the second respondent. Based on the said complaint, a case in Crime No.03 of 2014 was registered on 06.01.2024 for “Man Missing”. Upon completion of investigation, the second respondent-Police filed a final report on 08.08.2014 stating that the detenu remained undetected. It is further seen that R.C.S notice was also served on the petitioner. Without challenging the said notice, the petitioner remained silent for more than ten years and has now come forward with the present Habeas Corpus petition. Admittedly, there is no allegation of illegal detention, abduction or kidnapping and the case itself was closed in the year 2014 itself as a “man missing” case.

4. In view of the foregoing reasoning, this Court finds no ground to entertain the present petition. Accordingly, the Habeas Corpus Petition is closed. Since the second respondent-Police has already filed the final report, it is open to the petitioner to challenge the said final report in the manner known to law, if she so desires. (P.V.,J.)
