PRAYER: This writ petition is filed under Article 226 of the Constitution of India, seeking for issuance of writ of Certiorarified Mandamus, calling for the records of the Respondents, especially the order dated 31.01.1992 passed by the 2nd Respondent Under Section 9 (5) vide Na.Ka. 3731/ 91D and Notice dated 10.02.1993 issued Under Section 11 (5) of the Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978 in respect of land measuring 2400 Sq.ft bearing Plot No.14 of Shanmuga Nagar, Comprised in Survey No.36/9 of Numbal Village, Poonamallee Taluk, Tiruvallur District, and quash the same, and treat the proceedings as abated under Section 4 of the Tamil Nadu Urban Land (ceiling and Regulation) Repeal Act, (Act 20 of 1999) so as to enable the Respondents especially the 3rd Respondent, to incorporate the name of the Petitioner as owner of the land measuring 2400 Sq. ft of bearing Plot NO.14 of Shanmuga Nagar, comprised in New Survey No.36/9 of Numbal Village, Poonamallee Taluk, Tiruvallur District.

ORDER
The petitioner challenges the proceedings under the Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978 (the TN Urban Land Ceiling Act) and seeks to treat such proceedings as abated under Section 4 of the statute.
2. Learned counsel for the petitioner relies on earlier order dated
23.11.2021 in W.P.No.11690 of 2006 and related cases, as affirmed in judgment dated 27.07.2023 in W.A.No.1846 of 2023 and related cases. He points out that the challenge therein was also in respect of lands in S.No.36/9.
3. Learned Additional Advocate General concurs that the present writ petition also pertains to lands in S.No.36/9 which are covered in proceedings bearing Na.Ka.No.3731/91/D.
4. In order dated 23.11.2021, this Court concluded that physical possession was not taken by initiating action under Section 11(6) of the TN Urban Land Ceiling Act and that proceedings abated in view thereof. This position was affirmed by the Division Bench in appeal. Since such proceedings pertain to the same survey number and are covered under File Number Na.Ka.No.3731/91/D, the petitioner is entitled to the same relief. Therefore, this petition is allowed as prayed for. No costs. Consequently, connected miscellaneous petitions are closed.
