(Order of the Court was made by C.KUMARAPPAN,J.,)

The present Writ Petition has been filed seeking a direction to direct the respondents to remove the encroachments in Survey No.91/1 in Thiyaganur Village, Thalaivasal Taluk, Salem.

2. At this juncture, the learned Special Government Pleader on written instructions from the Tahsildar, Thalaivasal Taluk would submit that initially S.F.No.91/1 was classified as “Arasu Punjai Tharisu” in ‘A’ register vide Ref.No.TK 611/804/8586, dated 14.11.1985. The said land was assigned in the name of Ramasamy in Patta No.804 and since then the property continue to be a patta land. Therefore, there is no encroachment identified.

3. In view of the above submission, there is no reason to entertain the present Writ Petition. Therefore, the present Writ Petition is dismissed However, if any party claiming civil right may approach the competent civil Court of law if so advised. No costs.
