Prayer:- Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ or Order or Direction or any other nature of Writ of Mandamus, directing the respondents 1 and 2 to provide protection under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, based on the petitioner’s representation dated 26.12.2025 for the petitioner’s peaceful living in the petitioner’s house and properties without any hindrance from the respondents 5 and 6.

ORDER

Complaining about the enjoyment of the property by the petitioner who is the senior citizen and the safety, his dignity at this advanced age, it is seen that an application is made under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, however, to the District Collector, Salem. It is further stated that the said representation has already been forwarded to the Revenue Divisional Officer, Salem, the second respondent herein who is the competent authority as per the Act. Therefore, the petitioner prays that the application be disposed of.

2.When the matter came up for hearing, the learned Government Advocate taking notice on behalf of the respondents 1 to 3 would submit that the representation is made only to the Collector. The fourth respondent is represented by the learned Government Advocate would submit that the role of the Police would come, if only final orders are passed in the petition. Considering the nature of Order that is passed, the Writ Petition is disposed of at the admission stage without notice to the respondents 5 and 6. This Court is not expressing any opinion on the merits or the correctness of the allegation made by the petitioner. The Writ Petition is disposed of on the following terms:-

i)If the representation of the petitioner dated 26.12.2025 is not made over to the second respondent till date, the same shall be made over within one week from the date of the receipt of the web copy of the order. As and when the representation is made over to the file of the second respondent, the second respondent shall conduct an enquiry in the manner known to law by issuing notice to the petitioner as well as the respondents 4 and 5 or any other person interested and pass final orders thereon in accordance with law as expeditiously as possible, in any event, not later than five months from the date of receipt of the web copy of the order.
