ORDER

This Writ Petition has been filed praying to quash the proceedings issued on 02.09.2025 by the 3rd respondent and consequently to direct the 3rd respondent to treat the period of suspension from 18.01.2022 to 30.05.2025 as duty for all purpose and disburse the salary and other pensionary benefits admissible to the petitioner.

2. The learned counsel appearing for the petitioner would submit that the petitioner was placed under suspension due to pendency of a criminal case and subsequently the criminal case ended in acquittal. Thereafter the petitioner made representation to treat the suspension period as duty period since the respondents have paid subsistence allowance as on date. However, the same was rejected. Challenging the same, this writ petition has been filed. He further submitted that treating the suspension period as non duty period is unknown to Service Law.

3. The leaned counsel apearing for the respondents submitted that this Court may grant liberty to the respondents to withdraw the impugned order dated 02.09.2025 and to permit the respondents to pass fresh orders strictly in terms of the service rules.

4. In view of the above submission, the impugned order is set aside.

The respondents are granted liberty to pass fresh orders strictly in terms of the Service Rules of the respondents society.

5. With the above observation, this Writ Petition is allowed.

Consequently, connected miscellaneous petition is closed. No costs.
