ORDER
Heard Mr.T.S.Baskaran, learned counsel for the revision petitioner and Mr.V.Vasanth Kumar, learned counsel for the respondent.
2. The petitioner challenges the order in M.A.No.4 of 2019, dated
12.08.2024, passed by the learned Principal District Judge, Puducherry treating the petitioner as an encroacher and directing removal of encroachment. 3. It is the case of petitioner that petitioner is facing a civil suit in O.S.No.1220 of 2011 on the file of the II Additional District Munsif Court, Puducherry where the petitioner as defendant has contended that the plaintiff alone has encroached and it is not the petitioner who has encroached. Further, a counter claim has also been filed. Admittedly, the said suit is pending and it is in the stage of trial.
4. The respondent herein namely the Commissioner, Bahour Commune Panchayat, Puducherry is not a party to the suit proceedings. Independently, the respondent has initiated proceedings treating the petitioner as an encroacher. This is in respect of the very same property that the suit is pend
