ORDER

The petitioner has approached this Court for a Mandamus directing the respondents 1 and 2 herein to issue No Objection Certificate to undertake internship in the 3^rd respondent College Hospital based on the representation dated

11.11.2025.

Upon hearing the learned counsel for the petitioner, it can be seen that the petitioner got admitted in B.Sc (Operation Theatre and Anaesthesia Technology) in the 4^th respondent-college and completed the academic portion of the course. It is also mandatory to undergo an internship, which is mandatory so as to complete the course in all respects. The petitioner is a native of Kallakurichi Taluk and with great difficulty, her parents paid the fees to the private college, namely the 4^th respondent-college, where she underwent the course. Now, she is finding it difficult to travel up to Salem and stay there and complete the internship. Therefore the petitioner came up with the prayer to allow her to complete the Internship in Government Medical College, Kallakurichi.

3. As far as the internship in Government Medical College, Kallakurichi is concerned, the petitioner cannot be granted. Unless the petitioner would have come up on merits to got admission in the Government college, she cannot now be admitted indirectly in the Government college and complete her internship. She got only lesser marks and therefore, she was allotted only to the private college. Therefore, even if the petitioner finds it difficult to complete the course in Salem and she can choose any of the private College of her choice and complete the course.

With the above observation, when the Court adjourned the matter, the learned counsel for the petitioner submitted that the petitioner had approached the private college, more specifically, Arunai Medical College, Tiruvannamalai, and other private medical colleges and they are all willing to admit the petitioner.

However, they are first asking for NOC of the university.

In reply thereof the learned counsel for the University would submit that the petitioner has to first approach the College and the College has to come up with a communication to the University that it is willing to admit the petitioner for the internship and thereafter only the University can consider the request on merits and in accordance with law and pass orders granting NOC.

6. In view thereof, this Writ Petition is disposed of on the following terms:- (i)The petitioner shall approach the said Arunai Medical College or such other recognised private college, which is administering the course and conducting the internship.

(ii)Once the petitioner approaches, the concerned college shall express its willingness and write a communication to the second respondent-University about the same;

(iii)Upon receipt of the communication, the second respondent-University shall consider the same on its own merits in accordance with law and issue NOC so th
