O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to cancel Patta No.2323 relating to Survey Nos.281/2B2 and 283/2D, measuring an extent of 180 cents, standing in the name of S.Balasubramaniyan, based on the petitioner’s representation dated 05.01.2026, within a time frame to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fourth respondent, as no adverse orders are proposed to be passed against him.

3. The grievance of the petitioner is that the subject properties originally belonged to the petitioner’s maternal grandfather. The brothers of the petitioner’s mother, without her knowledge and without including her, fraudulently obtained a legal heir certificate and based on the same, sold the properties to one S.Balasubramanian, the fourth respondent herein. On the strength of the said documents, the fourth respondent mutated the patta in his name. The petitioner filed a petition before the Revenue Divisional Officer seeking cancellation of the fraudulent legal heir certificate. The Revenue Divisional Officer, after examining the records, cancelled the said legal heir certificate, as a result of which the sale deed executed on the basis of the said certificate became void. However, the patta continues to stand in the name of the fourth respondent. Therefore, the petitioner submitted a representation dated 05.01.2026 to the respondents seeking cancellation of the patta issued in the name of the fourth respondent. Since no action has been taken, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first to third respondents, on instructions, would submit that the petitioner's representation dated 05.01.2026 would be considered and appropriate orders would be passed by the second respondent within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 05.01.2026 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the fourth respondent and any other interested parties who may be affected by such decision, before passing any order. There shall be no order as to costs.
