COMMON ORDER
This Criminal Original Petitions have been filed by the petitioners seeking modification of the condition imposed on the petitioners in the order dated 07.11.2025 in Crl.M.P.No.10408 of 2025 and Crl.O.P.No.10407 of 2025, respectively, by the Court of Principal Sessions Judge at Chennai.

The learned counsel for the petitioners submitted that the petitioners have appeared on summons in respect of C.C.No.1669 of 2025 before the Additional Chief Metropolitan Magistrate, Egmore, Chennai. On appearance, the petitioners were asked to execute a bail bond to the value of Rs.1,00,000/- with two sureties and each surety shall execute a bond for like sum and one surety must be a blood relation of the petitioners.

Aggrieved over the same, the petitioners have also filed modification petition before the Principal Sessions Court, Chennai and as per the order dated 07.11.2025 passed in Crl.M.P.No.10408 of 2025 and Crl.M.P.No.10407 of 2025, respectively, the condition to execute a bond for Rs.1,00,000/- with two sureties was modified in to Rs.50,000/- with two sureties and all other conditions remain intact.
4. Aggrieved over the imposition of the condition that one of the surety must be a blood relative of the petitioners, this petitions have been filed seeking modification of the aforesaid condition.
5. This Court has considered that it is a case of fabrication of records and availing huge amount as a loan amount to the extent of Rs.12 crores, hence, imposition of the condition to the extent of executing bond for Rs.50,000/- is proper. However, imposition of the condition that one of the surety must be a blood relative of the petitioners is not necessary. Hence, this Court is inclined to modify the said condition imposed by this Court in the order dated 07.11.2025 in Crl.M.P.No.10408 of 2025 and Crl.M.P.No.10407 of
2025 by the Principal Sessions Judge at Chennai.

Accordingly, the same is modified as follows: “the Petitioner/Accused is directed to execute a bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, each surety shall execute a bond for likesum and the sureties are produced means document with satisfaction of this Court”. The other conditions imposed to the petitioner/Kamal Jain/A4 in Crl.M.P.No.12728 of 2025 dated 10.09.2025 and the petitioner/Poonam Anand/ A3 in Crl.M.P.No.123456 of 2025, dated 02.09.2025 shall remain intact.
7. With the above modification, this Criminal Original Petition is ordered.
