Respondents PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, praying to strike off the plaint, in O.S.No.21 of 2024, on the file of District Munsif Judge, Ponneri as against the 1st and 2nd defendant of the suit who are misjoinder party to suit and thereby allow the Civil Revision Petition.

2. The learned counsel appearing for the petitioner would submit that the respondent/plaintiff died on 21.05.2025 and till date, the legal representatives have not been brought on record before the trial Court.
3. Since the Legal Representatives of the first respondent/plaintiff, have not been brought on record, by operation of law, the suit gets abated. Therefore, the Civil Revision Petition cannot be proceeded. Accordingly, the Civil Revision Petition is closed with liberty to the petitioner to revive the same, in case, the abatement is set aside and legal representatives are brought on record in the main suit.
4. Accordingly, the Civil Revision Petition is closed. No costs.
Consequently, connected miscellaneous petition is closed.
