ORDER

This writ petition has been filed challenging the refusal check slip dated 09.12.2025 issued by the 2nd respondent and to direct the 2nd respondent to register the sale deed dated 09.12.2025 presented by the petitioner for registration.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the official respondents. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

The learned counsel for the petitioner would submit that when the petitioner presented the sale deed for registration, the same was refused by the 1st respondent on the ground that it is a temple property by referring to the communication/proceedings dated 02.07.2024 of the 2nd respondent/Assistant Commissioner. However, the learned counsel would submit that wrongly it has been entered in the 'A' Register as well as in the FMB sketch. However, the other lands have already been registered in similar circumstances. On these grounds, the learned counsel prays for interference.

5. Per contra, the learned Additional Government Pleader would submit that in the temple register, the property in question is not found place, however, in the A Register and also in the FMB sketch, it appears. If it is wrongly entered, steps may be taken by the petitioner to remove the same.

6. I have considered the rival submissions and perused the materials available on record.

7. It appears that in the present case, the petitioner presented a sale deed dated 09.12.2025, however, it came to be rejected citing the reason that it is a temple property. A perusal of the proceedings of the 2nd respondent/Assistant Commissioner of the HR&CE Department dated 02.07.2024, would show that as per the records of the temple, the property does not belong to the temple. However, a perusal of the A Register and FMB sketch, which are maintained by the revenue authorities, the records transpired that the property in question found place. Therefore, there is a contradiction in the register maintained by the temple as well as revenue authorities. Hence, the matter is remanded back to the first respondent. Accordingly, the 1st respondent is directed to issue notice to the parties concerned and upon conducting enquiry, a decision shall be taken taking into consideration of the proceedings of the 2nd respondent dated 02.07.2024 and orders shall be passed on merits and in accordance with law. It is made clear that while passing orders, the statement of the concerned Village Administrative Officer shall also be taken note of.

8. With the above direction, the writ petition is disposed of. No costs. Consequently connected Miscellaneous Petition is closed.
