Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to remove the illegal encroachment made by the fifth respondent in Punjai survey No.37/8A, Kadamalaikundu Village, Andipatti Taluk, Theni District and to restore the water channel(Odai) as per revenue records on the basis of the petitioner's representation.

O R D E R
Heard the learned counsel on either side.
2. The petitioner alleges that in survey No.37/8A of Kadamalaikundu village which is a water body, there are encroachments.
3. The learned Special Government Pleader confirms that survey No.37/8A has been classified as water body.
4. The second respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The entire exercise will be completed within a period of four months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
