Criminal Original Petition filed under Section 483(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, pleased to modify the Condition order passed by the learned Judicial Magistrate No.II in Cr.M.P.No.235 of 2026 in bail order conditions the petitioner is ordered to be released on bail on his executing a bond for Rs.25,000/- with two sureties for a like sum each to the satisfaction of trail court among them one surety shall be a blood surety dated on 06.02.2026 and bay be modified the condition.

ORDER

This petition has been filed seeking modification of the condition imposed on the petitioner in Crl.M.P.No.235 of 2026, dated 06.02.2026 on the file of the learned Judicial Magistrate Court No.2, Tambaram. The condition imposed is as follows :

a) The Petitioner/Accused shall execute a bond for Rs. 25,000/- along with two sureties for a likesum each and in which one must be blood relative or

spouse.

2. The learned counsel for the petitioner submitted that the petitioner is unable to produce two sureties, particularly a blood relative or spouse, as required by the above said order. It is further submitted that since the petitioner is in custody, he is not in a position to secure such sureties. Hence, the present petition has been filed to modify the said condition.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent and also perused the materials available on record, including the order passed by the learned Judicial Magistrate Court No.2, Tambaram.

4. Considering the fact that the petitioner is in custody, and is unable to produce a blood relative or close relative as surety, this Court is of the view that insisting upon such a condition is not necessary. Accordingly, the order dated 06.02.2026 passed in Crl.M.P.No.235 of 2026 is modified as follows :

“ a) The petitioner shall execute a Bond for Rs.25,000/- (Rupees Twenty-Five Thousand only) with two sureties for a like sum each.”

5. The other conditions imposed in the order dated 06.02.2026 passed in Crl.M.P.No.235 of 2026 shall remain unaltered.

6. Accordingly, the criminal original petition is ordered, and the condition is modified
