ORDER

This Writ Petition has been filed praying for direction to the respondents to pay medical bill of Rs.94,579/-(Rupees Ninety Four thousand five hundred and seventy Nine only) to the petitioner payable under New Health Insurance Scheme, 2021 for reimbursing Medical Expenditure incurred by the petitioner towards the surgery on 15.11.2024 with the interest at the rate of 12 percentage.

The learned counsel appearing for the petitioner would submit that the petitioner is a professor in Annamalai University and he is also a member of Tamilnadu Government Employees Health Fund Scheme, 2021 and subscription amount was regularly remitted from the petitioner’s salary. While so, the petitioner’s wife was admitted in hospital as in-patient at Kumaran Medical Centre, where she was diagnosed with gross deviated nasal septum (DNS), inferior turbinate hypertrophy (ITH), right concha bullosa, and chronic sinusitis. Surgery was performed on 26.08.2024. Thereafter, the petitioner’s wife was discharged on 27.08.2024. Thereafter the petitioner made a medical reimbursement claim before the fifth respondent. However, the fifth respondent rejected the petitioner’s medical reimbursement claim vide order dated 10.01.2025 on the ground that the petitioner was treated in the hospital which is not covered under the applicable Government Orders. Aggrieved by the same, the petitioner made appeal before the first respondent. However, no order was passed. Hence, this writ petition has been filed.

The learned Government Advocate appearing for respondents 1,2, 3 & 6 submitted that the fifth respondent passed rejection order and the remedy is available before the District Level Empowered Committee or State Level Empowered Committee or High Level Empowered Committee and hence, this Court may issue a direction to the petitioner to approach the empowered committee concerned against the order of the fifth respondent dated 10.01.2025.

In view of the above submissions, liberty is granted to the petitioner to approach the appropriate empowered committee against the order of the fifth respondent dated 10.01.2025 within a period of two weeks from the date of receipt of this order. On receipt of the same, such Empowered Committee is directed to consider the case of the petitioner and pass appropriate orders within a period of six weeks thereafter after providing opportunity to the fifth respondent.

5. With the above directions, this writ petition is disposed of. No costs.
