Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the 2nd respondent to cancel the patta standing in the name of the 5th respondent in respect of the lands comprised in Survey Nos.119/3B and 119/4 situated at Velampatti Village, Harur Taluk, Dharmapuri District, and consequently direct the respondents to issue patta in favour of the petitioner and make necessary entries in the revenue records within a time frame to be fixed by this Court.

ORDER

This writ petition has been filed seeking for a direction to the third respondent to cancel the patta standing in the name of the fifth respondent for the property morefully described in the prayer to this writ petition, and thereafter, issue patta in favour of the petitioner for the very same property, based on the petitioner’s representation dated 05.07.2024, within a time frame to be fixed by this Court.

2. According to the petitioner, illegally, the fifth respondent has obtained patta in his name for the subject property. The petitioner seeks for cancellation of the same. The petitioner had submitted a representation on 05.07.2024 to the third respondent seeking for cancellation of the patta issued in favour of the fifth respondent for the subject property. Since the said representation has not been considered till date, the petitioner has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4. Since no adverse orders are passed against the fifth respondent, notice to the fifth respondent in this writ petition is dispensed with.

4. No prejudice will be caused to the official respondents, if the aforesaid representation of the petitioner is considered, on merits and in accordance with law, after hearing the objections if any from the fifth respondent as well as any other party whom the official respondents deem it fit to enquire, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the third respondent to pass final orders on the petitioner’s representation dated 05.07.2024 seeking for cancellation of patta standing in the name of the fifth respondent for the subject property, after hearing the objections if any from the fifth respondent as well as any other party whom the third respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the aforesaid representation of the petitioner. No Costs.
