3.The Tahsildar, Tahsildar Office, Vedasandur Taluk, Dindigul District.

4.Malligapeevi ... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus to call for the records, pertaining to the impugned order in MU.MU.No.7365/2024/A7, dated 03.06.2025 passed by the second respondent and quash the same as illegal, arbitrary and consequently direct the respondents to restore the old Patta in the petitioner’s name, of the landed property comprised in Survey No.1962/5 for an extent of 0.2.52 sq.meter situated at Vedasandur Village, Vedasandur Taluk, Dindigul District by considering the petitioner’s representation dated 10.01.2026. For Petitioner : Mr.S.Harish For R1 to R3 : Mr.P.Subbaraj Special Government Pleader *****

O R D E R

In this Writ Petition, the petitioner has challenged the impugned order dated 03.06.2025 bearing reference MU.MU.No.7365/2024/A7 passed by the second respondent.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that the impugned order has been passed by the second respondent without issuing notice to the petitioner, thereby cancelling the patta standing in the petitioner’s name and restoring the same in the name of the petitioner’s mother-in-law.

4. The learned Special Government Pleader appearing for the first to third respondents would fairly submit that the petitioner was not put on notice while passing the impugned order.

5. In view of the above, since the petitioner is affected by the impugned order and no notice was issued to her, though the patta stood in her name, the impugned order is liable to be set aside on the ground of violation of principles of natural justice. Accordingly, the matter is remitted back to the second respondent to issue notice to the petitioner, the fourth respondent and all other necessary parties, afford them an opportunity of hearing and pass appropriate orders afresh in accordance with law.

6. With the above observations, this Writ Petition is disposed of.

There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
