Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st to 4th respondents to conduct inspection and to take appropriate action to remove the encroachments made in the Government Porramboke Odai, comprised in S.No.207/3 situated at Pappambadi Village, Pappireddipatty Taluk, Dharmapuri District and to prevent the 5th respondent from encroaching the same by considering petitioner representations dated

12.04.2024 within a time period to be fixed by this Honourable Court.

Petitioner’s allegation is that though private respondent was earlier removed being an encroacher, pursuant to the direction issued by this Court on 27.06.2023, he has again encroached upon a part of water channel.

2. Respondents 3 and 4 shall conduct survey, if not already conducted and if any encroachment is found, forward the report to appropriate authority i.e. Water Resource Department or Panchayat or Revenue, as the case may be, who shall remove the encroachments. The exercise should be completed within a period of three months.

3. Petition is disposed of. There shall be no order as to costs.
