ORDER

This writ petition has been filed challenging the refusal check slip dated 22.09.2025 issued by the 2nd respondent and to direct the 2nd respondent to accept the sale deed dated 22.09.2025 presented by the petitioner for registration.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the official respondent. By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

3. When the petitioner presented the sale deed for registration, the same was refused to be registered by the 2nd respondent on the ground that the said property was sold in the year 1989 and thereafter in the year 2000 ie., several registrations in respect of the subject property.

Challenging the said refusal, the petitioner is before this Court.

4. The learned counsel for the petitioner would submit that the petitioner intends to execute a sale deed now. However, the same came to be refused to be registered citing the reason that the same land was already sold in the year 1989 and subsequently in the year 2000. However, he would submit that those transactions were set aside through the proceedings of the Sub Collector on 04.07.2025. Therefore, now there is no impediment for the 2nd respondent to register the sale deed.

5. The learned Special Government Pleader, on instructions, would submit that since the subject property was already sold, the sale deed came to be refused to be registered.

6. I have considered the rival submissions and perused the materials available on record.

7. It appears that in the present case, as rightly contended by both sides, the petitioner intends to execute a sale deed. It is also seen that the subject property was devolved upon legal heirs of one Kannan ie., Samboornam and their sons and from whom, the petitioner intends to purchase the property and presented the sale deed on 22.09.2025, which came to be refused on the ground that already the subject property was sold in the year 1989 and subsequently in the year 2000. Those transactions were nullified through the proceedings of the Sub Collector vide proceedings dated 04.07.2025 and hence, the petitioner is entitled to purchase the said property. The petitioner's vendors have valid title and the property devolved upon them on the demise of one Kannan. Therefore, there is no impediment for the 2nd respondent to register the sale deed presented by the petitioner. Therefore, while setting aside the impugned order, the petitioner is directed to represent the sale deed dated 22.09.2025 and upon such representation, the 2nd respondent shall register the same forthwith, if the same is otherwise in order.

8. The writ petition is disposed of with the above direction. No costs.
