JUDGMENT
(1)The appeal is filed to set aside the order dated 02.12.2025, made in Crl.MP.No.358/2025, by the learned Additional District and Sessions Judge, Special Court for the Exclusive Trial of PCR Act Cases, Sivagangai, rejecting the appellant's bail application.
(2)The case of the prosecution was that on 14.06.2021, when the defacto complainant was standing in front of his house, the appellant and one other accused, drove their two-wheeler in a rash and negligent manner and when the brother of the defacto complainant questioned the accused, they mocked at him and went away. Thereafter, when the defacto complainant was proceeding to his house near Mathur pond, the accused abused the complainant's brother with his caste name and attacked him with wooden stick and when the complainant questioned them, the accused attacked him with sword and also threatened him with dire consequences. Therefore, a case was registered in Crime No.148/2021 for the offences u/s.147, 148, 294[b], 323, 324, 506[ii] of IPC and under Sections 3[1][r] and 3[1][s] of SC/ST [POA] Act. After investigation, the respondent police filed a charge sheet against 9 accused including the appellant who is arraigned as A3 and the same was taken on file in Spl.SC.No.23/2021 on the file of the learned Additional District and Sessions Judge, Special Court for Exclusive Trial for PCR Act Cases, Sivagangai.
(3)During the pendency of the proceedings, the appellant filed the petition seeking his enlargement on bail. The Trial Court rejected the petition on the ground that the appellant jumped bail and only after a NBW was issued by the Court on 06.11.2025, the appellant was apprehended on 13.11.2025. The Trial Court also found that all the accused were not cooperating and therefore, the proceedings in the case were delayed. For the said reasons, the Trial Court dismissed the bail application.
(4)The learned Additional Public Prosecutor produced the CCTNS Portal of the Tamil Nadu Police and submitted that five cases were pending against the appellant and therefore, opposed the appeal.
(5)Heard both sides and perused the materials placed on record.
(6)Considering the antecedents of the appellant and the reasons stated by the Trial Court for rejecting the bail application of the appellant, this Court finds no compelling reasons to interfere with the order of the Trial Court.
(7)Hence, this Criminal Appeal is dismissed.
