ORDER

This Writ Petition has been filed praying for direction to the 1st respondent to revoke the order of suspension in Proceedings in Rc. No. 6413/A3/ 2023 dated 11.10.2023 issued against the petitioner by considering the petitioner’s representation dated 05.02.2024.

2. The learned counsel appearing for the petitioner would submit that the petitioner was appointed as Secondary Grade Teacher in the year 1991 and he joined duty in the second respondent’s office. From the date of joining, the petitioner is doing his work sincerely without any remarks. On 04.11.2022, a criminal case was registered as against the petitioner as if the petitioner had been running an unregistered chit for 10 years and the chit amount was not paid to a subscriber, thereby the alleged affected party filed complaint, which was registered in crime No.2 of 2022 for the offences under Sections 406, 409, 420 of IPC and Sectin 4(1), 11, 76(1) of Chit Funds Act. Thereafter, the petitioner was arrested and released on bail. Now, charge sheet has been filed in CC.No.505 of 2023 and the same is pending for trial. In the meanwhile, the respondents suspended the services of the petitioner from 11.10.2023 pursuant to the arrest and subsequently charge memo was issued on 22.01.2024. Though the petitioner is continuously in suspension from 11.10.2023 till date, the departmental proceedings has not been concluded and suspension order has also not been revoked, thereby this writ petition has been filed.

The learned counsel appearing for the petitioner would further submit that the petitioner is a school teacher and he is on continuous suspension from 11.10.2023 for two years by getting subsistence allowance. It is not useful to the students. The criminal case registered against the petitioner has nothing to do with the employment of the petitioner. If the petitioner is reinstated, it may be useful to the school children. Hence, this Court may issue direction to the respondents to consider revocation of the suspension order within the period stipulated by this Court.

4. In view of the above submission, the first respondent is directed to consider the revocation of suspension order passed against the petitioner and to pass orders on merits and in accordance with law within a period of two weeks from the date of receipt of this order.

5. With the above direction, this writ petition is disposed of. There shall be no orde as to costs.
