Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent in his proceeding dated 08.01.2024 vide Letter No. 050067/1096/F.63/PPO No.7755R/2024 and quash the same as illegal and consequentially to direct the respondents to grant family pension to the petitioner arising out of the State Government Civil Service of petitioner’s deceased father late A.Munusamy within the stipulated time.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records of the second respondent in his proceedings dated 08.01.2024 vide Letter No. 050067/1096/F.63/PPO No.7755R/2024 and quash the same as illegal and consequentially direct the respondents to grant family pension to the petitioner arising out of the State Government Civil Service of petitioner’s deceased father late A.Munusamy within the stipulated time.

2.The learned counsel appearing for the petitioner submitted that the petitioner is a deserted woman. The petitioner’s father was working as Foreman in the Office of the Junior Engineer, Chengam and he retired from service in the year 1992 and he received pension till his death on 29.01.1998. Thereafter, the petitioner’s mother received family pension till her death on 27.04.2014. Thereafter, the petitioner approached the respondents for family pension since her husband deserted her, however, the same was rejected by the respondents.

3.The learned counsel appearing for the respondents submitted that as per the Memorandum of the respondents, only un-married daughter and divorced woman are entitled to receive family pension and the petitioner is a deserted woman and deserted woman is not entitled to claim family pension.

4.Heard the arguments advanced on either side and perused the materials available on record.

5.Admittedly, the petitioner is a deserted woman. The petitioner’s father was working as Foreman in the Office of the Junior Engineer, Chengam and he retired from service in the year 1992 and he received pension till his death on 29.01.1998. Thereafter, the petitioner’s mother received family pension till her death on 27.04.2014. Thereafter, the petitioner approached the respondents for family pension since her husband deserted her and the same was rejected by the respondents.

6.As per the Memorandum of the respondents, only un-married daughter and divorced woman are entitled to receive family pension and the petitioner is a deserted woman and deserted woman is not entitled to claim family pension. Hence, the relief sought for in this writ petition cannot be granted.

7.The writ petition is dismissed. No costs.
