Prayer in CMP No. 1101 of 2026 :- The civil miscellaneous petition is filed under Section 151 of CPC, praying to dispense with the production of the certified copy of the Docket order dated 19.09.2025.

Prayer in CRP.Sr.No.6766 of 2026 :- Civil Revision Petition filed under Article 227 of the Constitution of India praying to set aside the docket order dated 19.09.2025 passed in O.S.No.5862 of 2016 on the file of the learned III Additional City Civil Court, Chennai.

ORDER

The Civil Revision Petition is filed challenging the docket order passed by the trial court dated 19.09.2025 in O.S.No. 5862 of 2016.

2. It is seen from the order dated 19.09.2025 enclosed in Page No. 17 of the typed set of papers and the certified copy of the petition and order in IA.No.7 of 2025 enclosed in additional typed set of papers dated 06.02.2026, IA.No. 7 of 2025 filed by the petitioner seeking to reopen the case was dismissed for his non-appearance. If IA.No. 7 of 2025 is dismissed for non- appearance, it is for the petitioner to file appropriate application before the court concerned seeking restoration of the same by showing sufficient cause. The order passed by the trial court dismissing the IA.No. 7 of 2025 for default of the petitioner cannot be the subject matter of the revision when petitioner has effective remedy under Order IX Rule 9 of CPC before the trial court. Hence, this Court is not inclined to order this civil miscellaneous petition. Accordingly, the CMP.No.1101 of 2026 is dismissed and the civil revision petition is rejected in SR stage itself.
