ORDER
This Criminal Revision Petition has been filed by the petitioner seeking to set aside the order dated 01.09.2025 in Crl.M.P.No.1006 of 2025 passed by the learned Judicial Magistrate No.1, Tindivanam.
2. The brief facts of the case are that petitioner and respondent are husband and wife. Their marriage took place on 25.05.2012 at Sri Lakshmi Narayana Thirumana Mandapam at Tindivanam as per the Hindu Rites and Customs. They have two minor sons viz., Vigneshwaran and Ishanth. Due to the misunderstanding between the petitioner and respondent, respondent/wife had filed a petition before the Protection Officer, pursuant to which, petitioner/husband appeared before the Protection Officer and gave a written explanation stating that he is ready to protect the respondent/wife and their two minor children. However, respondent/wife had filed a petition in Crl.M.P.No.1006 of 2025 before the Court of Judicial Magistrate No.1, Tindivanam seeking protection and residence relief. On 01.09.2025, the learned Judicial Magistrate No.1, Tindivanam has passed an order in Crl.M.P.No.1006 of 2025. The operative portion of the said order reads as follows:
“3. Considering the submissions and materials placed before this Court and in order to ensure the protection of the rights of the petitioner, this Court is of the view that immediate protective relief is necessary.
4. Accordingly, it is hereby ordered as follows:
1. The petitioner shall be permitted to reside in her shared household, without any interference or obstruction from the respondents.
2. The respondent is directed to provide one separate bedroom, bathroom and kitchen in the shared household for the resident of the petitioner.
3. The Protection Officer is directed to ensure the peaceful resident of the petitioner in the said household with the assistant of the local police, if necessary.
4. The Protection Officer shall monitor the compliance of this order and file a compliance report before this Court.”
Aggrieved by the said order, petitioner/husband has filed the present Criminal Revision Petition before this Court.
3. Heard the learned counsel for petitioner/husband and perused the materials available on record.
4. The issue involved in the case on hand is a family dispute between the husband and wife. Since the family dispute is of civil nature, this Court cannot entertain the present petition. Therefore, this Criminal Revision Petition is dismissed. However, liberty is granted to the petitioner/husband to approach the appropriate civil forum, in the manner known to law.
Consequently, connected Miscellaneous Petition is also closed.
