Versus
The District Collector Tiruvallur District – Respondent
W.P No. 6633 of 2026
For the Appellants/Petitioners: Mr.K.Balasubramaniam
For the Respondents:Mr.M.Habeeb Rahman Government Advocate
Judicial intervention in land encroachment cases is limited when proceedings are already underway.
Headnote:The case pertains to a challenge under Article 226 concerning encroachment on government land. The petitioner sought the removal of encroachments, stating proceedings were pending against an eviction order issued. The court found no basis for entertaining the writ, leading to dismissal. The central issue was the procedural status of land encroachment actions taken by governmental authorities. The court upheld that the ongoing appellate process precludes immediate judicial intervention.
