(Order of the Court was made by DR.G.JAYACHANDRAN The Writ Petition is filed to direct the respondents 2 and 3 to consider the grant of family pension to the Petitioner under the category of Widowed daughter in terms of Rule 49 of the Tamil Nadu Pension Rules read with G.O.(Ms)No.325, dated 28.1.2011 issued by the Finance(Pension)Department .

2.Mr.D.Sivaraman, learned Standing Counsel takes notice for the first respondent, Mr.P.Gunasekaran, learned counsel takes notice for the second respondent and Mr.D.Sasikumar, learned Additional Government Pleader takes notice for the third respondent.

3.The case of the Petitioner is that her father served in the Tamil Nadu Subordinate Judiciary Service and died in the year 1992. After his demise, her mother was receiving family pension. By virtue of G.O.(Ms)No.325, dated 28.1.2011 issued by the Finance(Pension)Department, the widowed daughters of Government servant are also entitled for family pension. Therefore, she being entitled to claim family pension, made a request to the Pension Payment Officer on 19.2.2025 to consider her request for grant of family pension. Hence the present Writ Petition is filed seeking a mandamus as aforesaid.

4.The learned Standing Counsel appearing for the second respondent submitted that the Petitioner had made representation for extending the benefit of family pension to her under the category of widowed daughter. However, her representation was not in the prescribed format or with necessary documents for consideration. Therefore, the second respondent had rejected the representation with instructions to submit the application in the prescribed format with necessary documents through employer of the Government servant.

5.The learned counsel appearing for the respondents 2 and 3 submitted that the Pension Payment Officer is not the competent person and the representation is not given in the prescribed format and it did not contain all the necessary enclosures. They would further submit that if the application for payment of pension is made in the prescribed format with all necessary documents, the same will be considered in accordance with law.

6.The learned Standing Counsel for the first respondent would submit that if any application is made in the prescribed format, as an employer, the first respondent will forward it to the appropriate authority for consideration.
