PRAYER : Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the respondent for flouting and disobeying the order dated 16.02.2024 passed in W.P.No. 26661 of 2021 and for abusing the process of this Hon'ble Court under the provisions of contempt of Courts Act.

ORDER

This contempt petition is filed for non-compliance of the order of this Court dated 16.02.2024 in W.P.No.26661 of 2021.

2. The Contemnor/2nd Respondent is present before this Court today.

3. Today when the matter is taken up for hearing, learned counsel for the respondent has placed before this Court a memo of compliance dated 18.02.2026, whereby, it is stated that the respondents have not only considered the representation of the petitioner dated 11.11.2021 as directed by this Court by the order dated 16.02.2024, but also have made the payment of terminal benefits due to the petitioner in the form of Backwages, Gratuity Amount and employee contribution of Provident Fund in all of total of Rs.49,25,168/- (Rupees forty nine lakh twenty five thousand one hundred and sixty eight only)

4. Learned Special Government Pleader further submits that the respondents thereafter have also fixed monthly pension payable as Rs.21,750/- and the same will be credited to the account of legal heir of Ex-workman, payable from the month of March 2026.

5. By the memo of compliance dated 18.02.2026, it is also stated that since, the monthly pension amount having now been fixed to be paid to the legal heirs of the Ex-workman, the pension arrears amount of Rs.11,23,984/- would also to be paid to the account of the legal heir in the month of March 2026.

Learned Special Government Pleader by stating as above has placed before this Court the Stamp Receipt as issued by the respondents on 16.02.2026 in respect of sum of Rs.33,32,684/- towards backwages amount; the receipt for a sum of Rs.7,04,700/- towards Gratuity Amount and receipt for a sum of Rs.8,87,784/- of employee contribution towards settlement of Provident Fund.

7. Learned Special Government Pleader has also placed a copy of the proceedings dated 13.02.2026, whereby, the monthly pension payable in a sum of Rs.21,750/- p.m. has been fixed, commencing from the month of February

2026 payable from March 2026 onwards.

8. The memo of compliance dated 18.02.2026 as filed by the learned Special Government Pleader along with the other copies of the receipts and the PPO sanction receipt are taken on record.

9. Since, it is now stated to this Court that the respondents have complied with the order of this Court in its letter and spirit by not only disposing of the representation of the petitioner dated 11.11.2021 but also granting the monetary benefits thereunder, this Court is of the view that there is no necessity to proceed with the present contempt case.

10. Accordingly, this contempt petition is closed.
