PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to de-seal the premises based on the representation of the petitioner dated 26.12.2025 and to pass orders.

ORDER

The writ petition has been filed seeking a direction to the respondent to consider the petitioner's representation dated 26.12.2025 and to de-seal the petitioner's premises.

2. The petitioner Trust was established in the year 2008 with an objective to provide educational assistance, medical relief and for the welfare of the women and children. In the year 2010, a school by name Swami Dayanand Vidyalaya Matriculation School came to be established by the Trust, which later was closed on the onset of COVID-19 pandemic. Later, few persons were appointed to take care of the premises, who had permitted to run a school viz., Wisdom Public School, which according to the petitioner is an unauthorised and unapproved school. Therefore, the petitioner Trust had approached this Court in WP.No.27755 of 2025 for closure of the said school and had obtained an order of this Court, pursuant to which, the Wisdom Public School was closed on 31.10.2025. Thereafter, on 17.11.2025, the petitioner Trust convened a meeting for removal of the alleged caretakers and to de-seal the premises.

The petitioner would submit that the petitioner-Trust is the absolute owner of the land and the school premises, and they are in no way connected with the Management and functioning of the unauthorised and unapproved school. Therefore, the sealing of the premises was done with an intent to remove the unapproved school functioning in the subject property, and now the alleged caretakers and the Management of the school have been removed. The premises remains locked and lying idle from October 2025. If the property continues to remain closed, it would become unusable. Hence, a representation was submitted to the respondent on 26.12.2025 requesting to de-seal the premises. Since the same was not considered to date, the petitioner is before this Court. The petitioner also undertakes that no such unauthorised functioning of the school or related activities would take place in the Trust property.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5. Considering the facts and circumstances of the case and without going into the merits of the case, this Court directs the petitioner to issue a fresh representation in this regard to the respondent forthwith, who shall consider the same, conduct necessary enquiry and pass orders in the manner known to law within a period of three weeks from the date of receipt of a copy of this order.

6. With the above observation, the writ petition is disposed of. No costs.
