ORDER

This criminal original petition has been filed seeking to direct the respondent-police to register a case based on the petitioner’s complaint and to investigate the same in accordance with law, in view of the order passed by the learned Judicial Magistrate No.II, Chidambaram in Crl.M.P.No.3623 of 2023.

2. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondent, on instructions, submitted that pursuant to the order dated 10.08.2023 passed by the learned Judicial Magistrate No.II, Chidambaram in Crl.M.P.No.3623 of 2023, directing the respondent to conduct preliminary enquiry in the petitioner’s complaint in accordance with Chapter XII of the Code of Criminal Procedure, the respondent-police have conducted enquiry/investigation and filed a report before the learned Judicial Magistrate No.II, Chidambaram as early as on 07.10.2023 stating that no case of cognizable offence has been made out to register an FIR on the petitioner’s complaint and a copy of the said report was also served on the petitioner on 03.10.2023 itself.

3. In view of the above, this Court is of the view that the order dated

10.08.2023 passed by the learned Judicial Magistrate No.II, Chidambaram in Crl.M.P.No.3623 of 2023 is complied with and therefore, no further order is necessary in this petition.

4. This criminal original petition stands closed accordingly. However, the petitioner is at liberty to challenge the said report and work out his remedy in the manner known to law, if so advised.
