ORDER

This petition has been filed seeking a direction to the respondents No. 3 and 4 to forthwith sanction and disburse the medical reimbursement in terms of the proceedings of the 2nd respondent dated 19.03.2020 in RC No. 107745/

2019/D1.

2. The case of the petitioner is that he is the husband of one Meharban, who was employed as a staff member at ADJ Polytechnic College, Nagapattinam. The petitioner’s wife was a beneficiary under the New Health Insurance Scheme, 2012. During the course of her employment, she suffered from Diabetes Mellitus with Hypertension and Chronic Kidney Disease- Stage III and underwent treatment at Meenakshi Hospital, Thanjavur which is an approved hospital under the said scheme. His wife was admitted as an inpatient from 28.05.2019 to 07.06.2019 and the total medical expenditure incurred for the said treatment amounted to Rs.2,46,102/- which was borne by the petitioner from his personal resources. Unfortunately, despite the treatment, the petitioner’s wife passed away on 08.06.2019. The petitioner, being her legal heir, thereafter, claimed medical reimbursement along with relevant medical records before the 2^nd respondent /District Level Empowered Committee, Nagapattinam. Upon thorough scrutiny of the records, the Committee, under the Chairmanship of the District Collector, Nagapattinam passed proceedings in R.C No.10775/2019/D1 dated 19.03.2020 categorically directing M/s.United India Insurance Company Ltd., to consider the petitioner’s claim and disburse the reimbursement amount in accordance with the rules in force. In compliance with the said proceedings, the petitioner submitted all original medical bills and supporting documents to the respondent Insurance Company on 21.03.2020. Despite the lapse of more than five years from the date of submission and notwithstanding the binding order passed by the competent authority, the respondents have failed to sanction or disburse the reimbursement amount. The petitioner made a detailed representation on 19.02.2025 followed by a second representation on 18.12.225, requesting the respondents to implement the order of the District Collector and release the sanctioned amount. Unfortunately, both the representations have remained unattended and unanswered till date. Hence, the present writ petition has been filed.

3.The learned counsel for the petitioner would submit that this Court may issue a direction to the 3^rd and 4^th respondents to implement the order of the 2^nd respondent dated 19.03.2020 within a reasonable time to be fixed by this Court.

4.Since no adverse order has been passed against the 3^rd and 4^th respondents, notice to the 3^rd and 4^th respondents is dispensed with.

5.In view of the above, there shall be a direction to the 3^rd and 4^th respondents to hear the petitioner and implement the order of the 2
