PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to direct the 1st respondent to issue the modified birth extract of the child Miss S.Eeshanthika born on 12.05.2021 and registered vide Reg.No. B-2021.33-15388-000042, dated 20.05.2021 issued by the 1st respondent on 07.07.2022 by replacing the names and address of the biological parents with the petitioners herein by considering and passing orders on the petitioners representation dated 11.12.2025.

ORDER

The writ petition has been filed seeking the following relief :

“ To direct the 1st respondent to issue the modified birth extract of the child Miss S.Eeshanthika born on 12.05.2021 and registered vide Reg.No. B-2021.33-15388-000042, dated 20.05.2021 issued by the 1st respondent on 07.07.2022 by replacing the names and address of the biological parents with the petitioners herein by considering and passing orders on the petitioners representation dated 11.12.2025.”

The petitioners herein are the husband and wife, who had adopted the girl child born to the brother of the second respondent named S..Eeshanthika vide Deed of Adoption registered as Document No.161/Book IV/2024, dated 14.05.2024 on the file of Sub Registrar Office, Avadi. The petitioners would submit that they had approached the respondents with a representation dated 11.12.2025, to carry out necessary modifications in the birth certificate of the girl child to include their names (the Adoptive Parents) in place of biological parents. But the same has not been considered by the first respondent to date.

Hence, the petitioners are before this Court.

The petitioners would draw reference to the circular of the Registrar General of India vide Circular No.1/7/2011-VS(CRS), dated 12.03.2012, wherein the Registrar General of India had directed the Registrars across India to issue Birth Certificates for the adopted children by recording the names of the adoptive parents "as Parents". The petitioner would submit that the Circular also mandates that the authorities concerned shall issue the Birth Certificate of the adopted child within 7 to 10 days from the date of submission of the application before the concerned Registrar.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5. Since the case in hand is a non-institutional adoption and there is no dispute relating to the adoption or birth of the child and also the fact that the Deed of Adoption was registered and the change of initial of the girl child has been published in the Tamil Nadu Government Gazette issued on 27.11.2024 itself, this Court directs the first respondent to dispose of the representation of the petitioners by effecting necessary entries in the birth certificate of the minor child and pass orders, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

6. With the above directions, the writ petition is disposed of. No costs.
