This Writ Petition has been filed seeking a direction to the respondents to consider the claim of the Petitioner and allot one post of the Veterinary Assistant Surgeons under the category of deaf and dumb which is carry forward post or any other category and to pass appropriate orders within the time that may be stipulated by this Court.
2. Learned counsel appearing for the petitioner submitted that the petitioner is aged about 51 years and is a physically challenged person having “Hemiparesis” partial paralysis of one side of the body with disability of 45%. He was appointed as Veterinary Assistant Surgeon through employment exchange under Rule 10(a)(i) under State and Subordinate Service Rules vide G.O. (Ms).No.137 dated 14.11.2011, Animal Husbandry, Dairying and Fisheries (AH-7) Department upon clearing the special qualifying examination conducted by TNPSC.

It is the further submission of the learned counsel that, pursuant to the recruitment notification dated 18.11.2022 issued by the 3rd respondent inviting applications for the post of Veterinary Assistant Surgeon, the petitioner had applied for the said post. However, inadvertently, he applied under the General Quota instead of the Disability Quota reserved for persons with benchmark disability with reference to the above notification. As per the said notification, 30 vacancies were earmarked as carried forward vacancies reserved for the deaf and dumb. It is his grievance that, respondents were proposing to convert the said vacancies into general category and fill them up accordingly. and were also proposing to terminate the petitioner from service. Therefore, he submitted a representation dated 29.01.2024 to the respondents seeking consideration of his candidature under the physically challenged persons. Since, the said representation was not considered, the present Writ Petition has been filed. 4. Learned counsel appearing for the respondents submitted that the post of Veterinary Assistant Surgeons under the relevant category have already been filled up pursuant to the 2024 notification and therefore, the prayer sought for in this Writ Petition has become infructuous.

5. In view of the aforesaid submission, nothing survives for further adjudication in this Writ Petition. Accordingly, this Writ Petition stands dismissed as infructuous. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
