ORDER
WMP. No.7801 of 2026 is ordered subject to the payment of separate court fee.
2.This writ petition has been filed to direct the second respondent to re-
determine the compensation awarded to the petitioners’ lands, morefully disclosed in the affidavit filed in support of this writ petition under Section 28-A of the Land Acquisition Act, 1894, based on the petitioners’ representation dated
17.02.2025, within a time frame to be fixed by this Court.
3.The petitioner seeks for enhancement of compensation for the acquired lands under Section 28-A of the Land Acquisition Act, 1894 pursuant to the Civil Court judgment passed in LAOP No.1 of 2017 on the file of the II Additional District Judge, Puducherry. Since the representation of the petitioner dated 17.02.2025, referred to supra, has not been considered till date, the petitioner has filed this writ petition.
4.Mr.R.Sridhar, learned Additional Government Pleader accepts notice on behalf of the respondents.
5.No prejudice would be caused to the respondents if the petitioners’
representation dated 17.02.2025 submitted under Section 28-A of the Land Acquisition Act seeking for enhanced compensation is considered, on merits and in accordance with law, within a time frame to be fixed by this Court. 6.This Court is not expressing any opinion on the merits of the petitioners’ representation. This Court is also not expressing any opinion as to whether the representation of the petitioners dated 17.02.2025 is well within the period of limitation as prescribed under Section 28 of the Land Acquisition Act or not.
7.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioners’ representation dated 17.02.2025 seeking for enhanced compensation in respect of the property acquired from the petitioner and morefully disclosed in the affidavit filed in support of this writ petition, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
