ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the first respondent to consider the application dated 08.01.2025 within a time period as stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 2 to 5, notice to the respondents 2 to 5 is hereby dispensed with.

4. The learned counsel for the petitioners would submit that the petitioners'

father was a registered cultivating tenant and he was undertaking cultivation in the subject property along with the petitioners during his life time and after his demise, the petitioners are in possession and cultivation thereof. While so, the fourth respondent, who is the brother of the petitioners, attempted to defeat the tenancy rights of the petitioners by taking various measures and ultimately, he purchased the subject property through his wife, the third respondent herein and is attempting to illegally dispossess the petitioners. Therefore, the petitioners have filed a suit in O.S.No.8 of 2025 before the District Munsif Court, Trichy, for permanent injunction and the same is pending adjudication. The petitioners have submitted a representation dated 08.01.2025 to modify the entry in the record of tenancy rights, which is still pending in the name of the petitioners' father. However, even after a lapse of more than a year, there is no progress. Hence, the present Writ Petition.

5. The learned Special Government Pleader appearing for the first respondent would submit that the petitioner's representation will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 08.01.2025, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the respondents 2 to 5 and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
