PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the Respondents 1 to 8 to remove the pipelines illegally laid by the 9th respondent beneath the Mulanur- Kondegoundenpalayam Road in S.F.No.32 situated at Mulanur Village, Pollachi Taluk within the time frame fixed by this court and consequently, restrain the 9th respondent from illegally laying pipeline, drawing water and transferring the same from the open well situated in his lands in S.F. No.22/2A2C at Mulanur Village to his other lands at virugalpatti village and Anikadavu Village, Tiruppur District.

ORDER

This Writ Petition has been filed seeking a direction to the respondents 1 to 8 to remove the pipelines illegally laid by the 9th respondent beneath the Mulanur- Kondegoundenpalayam Road in S.F.No.32 situated at Mulanur Village, Pollachi Taluk within the time frame fixed by this Court and consequently to restrain the 9th respondent from illegally laying pipeline, drawing water and transferring the same from the open well situated in his lands in S.F. No.22/2A2C at Mulanur Village to his other lands at virugalpatti village and Anikadavu Village, Tiruppur District.

2. When the matter had come up on 20.02.2026, this had passed the following order:

“It is fairly admitted that the pipe lines which have been demarcated in violet in the sketch attached in page no:52 of this petition are the pipe lines laid by the 9th respondent without getting any permission. Therefore, it is clear that the pipe lines laid are illegally laid ones and the same shall be removed and report shall be filed in this regard. Post the matter on 24.02.2026, for filing report.”

3. Today when the matter is taken up for hearing, the learned Additional Government Pleader appearing for respondents would submit that a communication has been received from the Tahsildar bearing Na.Ka.No.645/2026/Aa2 dated 24.02.2026 wherein it has been stated as follows:
