The petitioner, as the sole accused, reached a compromise with the defacto complainant, who acknowledged the agreement to quash the case, resulting in the court’s decision to quash the charge sheet and allow withdrawal of a deposited amount. The court determined the charge sheet was quashed based on the parties' compromise.

ORDER

The present petition has been filed by the sole accused in C.C.No.51 of

2026 on the file of the Judicial Magistrate, Rajapalayam seeking to quash the charge sheet wherein she has been charge sheeted for the offence under Section 420 I.P.C.

2.Pending trial, the parties have entered into a compromise wherein the defacto complainant has agreed for quashing of the criminal case as against the petitioner on condition that he should be permitted to withdraw a sum of Rs.2,50,000/- which has been deposited by the petitioner to the credit of Judicial Magistrate, Rajapalayam in Crime No.214 of 2024.

3.The defacto complainant has appeared in person and has also acknowledged the compromise and he has no objection for quashing the charge sheet.

4.In view of the above said facts, this Court is inclined to pass the following orders:

a)The charge sheet in C.C.No.51 of 2026 on the file of the Judicial Magistrate, Rajapalayam is hereby quashed.

b)The second respondent/defacto complainant is permitted to withdraw a sum of Rs.2,50,000/- which has been deposited to the credit of Judicial Magistrate, Rajapalayam in Crime No.214 of 2024.

5.With the above said directions, this Criminal Original Petition stands allowed.
