Headnote:The petitioner sought a writ of certiorarified mandamus to quash the proceeding of the respondents refusing electricity connection. The court found that a property dispute is pending between parties that barred granting relief. Thus, the Writ Petition was dismissed. The petitioner is allowed to seek relief via an interlocutory application in the civil court. There shall be no order as to costs.

ORDER

The impugned proceeding vide Letter No Asst. Engineer / O and M) /

West / Hosur / Ko. Thani /No. 045 / 2024 dated 04.09.2024 issued by the second respondent, is put under challenge in the present Writ Petition. Consequently, the petitioner has sought for a direction to the respondents 1 & 2 herein to provide electricity service connection forthwith to the shed adjoining house situated in Survey No 133, Shanthi Nagar, Hosur, Krishnagiri District based on the petitioner’s application bearing Reference No 20080610324185 dated 15.03.2024, within the time frame as fixed by this Court.

2. Heard the learned counsels appearing on either side.

The learned counsel for the petitioner submitted that the petitioner is in possession of the property and he made an application for electricity service connection to the shed adjoining to his house, however the respondents refused to provide the same on the objection made by the third respondent and hence, the present Writ Petition.

4. Per contra, the learned counsel for the third respondent submitted that the petitioner is not in possession of the property and there is a property dispute between the petitioner and the third respondent and a civil suit in regard to partition in O.S.No.88 of 2022 is pending before the Principal District Judge, Hosur and hence, prayed for dismissal of the petition.

5. Considering the facts and circumstances of the case and since there is property dispute pending between the parties before the Court below, this Court is not in a position to grant the relief sought for by the petitioner and hence, the Writ Petition stands dismissed. However, the petitioner is at liberty to file an interlocutory application before the Civil Court for effecting electricity service connection to the subject premises. There shall be no order as to costs.
