O R D E R
This Writ Petition (Criminal) has been filed seeking to forbear the respondents from interfering with the petitioner’s running of eatery named M/s. Karthick Tiffin Centre (R.V.Caters) functioning at No.C-44, 2nd Avenue, 12th Main Road, Anna Nagar, Chennai- 600 040 during late night hours.
2. Learned Government Advocate (Crl.Side) appearing for the respondents would submit that the respondents are not preventing the petitioner from running the shop; since the petitioner has not made any arrangements to their customers to sit and eat, they are parking their vehicles haphazardly, thereby, causing disturbance of the flow of traffic. He would further submit that though this Court, in WP.No.10512 of 2018 vide order dated 03.02.2022, have directed the police authorities to be vigilant and take earnest safety measures at all times and ensure that no law and order problem would arise, so that the eatery shops/hotels/restaurants can function peacefully without any interruption and this Court also directed the police authorities to take action in accordance with law in the event of owners of the eatery shops/hotels/restaurants found to be indulging in any illegal or prohibited activities, the petitioner has not provided any parking space to their customers, which resulted in chaos in the locality and hence, the respondent police are taking action only to clear the traffic and other than that, they are not interfering in the business of the petitioner.
3. Learned counsel for the petitioner would submit that the petitioner will ensure that unnecessary parking is not be done in that area.
4. Recording the submission of both the parties, this petition stands closed. Consequently, connected miscellaneous petition is also closed. However, liberty is granted to the respondents to take action in accordance with law in the event of customers of the petitioner causing disturbance to the traffic. No costs.
