Joint trials for related cases improve judicial efficiency and ensure a cohesive resolution.

Headnote:The transfer of proceedings in CC.No.347/2023 to the Sub Judge for a joint trial was sought based on the linkage of cases arising from the same police station. The Court found that since both cases originate from related incidents, a joint trial before the same court ensures judicial efficiency. The Criminal Original Petition is allowed with directions for a swift conclusion of the joint trial.

To transfer the proceedings in CC.No.347/2023 on the file of the learned Judicial Magistrate No.II, Usilampatti, Madurai to the file of the learned Sub Judge, Usilampatti, Madurai and that learned Sub Judge, Usilampatti, Madurai may be directed to conduct joint trial in C.C.No.

347 of 2023 and S.C.No.32 of 2022.

ORDER

This Criminal Original Petition is filed to transfer the proceedings in CC.No.347/2023 on the file of the learned Judicial Magistrate No.II, Usilampatti, Madurai, to the file of the learned Sub Judge, Usilampatti, Madurai and that learned Sub Judge, Usilampatti, Madurai may be directed to conduct joint trial in C.C.No.347 of 2023 and S.C.No.32 of

2022.

2. Learned counsel for the petitioner submitted that the two cases have been registered in Crime No.131 of 2021 and 132 of 2021 as case and case in counter. In both the cases, charge sheet have been filed in C.C.No.347 of 2023 before the learned Judicial Magistrate No.II, Usilampatti and in S.C.No.32 of 2022 before the learned Subordinate Judge, Usilampatti, madurai. Seeking joint trial in both the cases, by transferring the proceedings in CC.No.347/2023 on the file of the learned Judicial Magistrate No.II, Usilampatti, Madurai, to the file of the learned Sub Judge, Usilampatti, Madurai District, the present petition is filed.

3. Learned Additional Public Prosecutor submitted that since both the proceedings have culminated from a case and a counter case before the same police station, both the cases can be tried together before a same Court.

4. Heard both sides and perused the materials available on record.

5. Since no adverse order is passed as against the respondents 2 to

5 herein, notice to the respondents 2 to 5 is dispensed with.

6. In view of the above submissions, the proceedings in CC.No.

347/2023 on the file of the learned Judicial Magistrate No.II, Usilampatti, Madurai, is withdrawn from the file of the learned Judicial Magistrate No.II, Usilampatti, Madurai, and transferred to the file of the learned Sub Judge, Usilampatti, Madurai. The learned Sub Judge, Usilampatti, Madurai, is directed to conduct a joint trial in both the cases and conclude the same as expeditiously as possible.

7. Accordingly, this Criminal Original Petition is allowed.

Consequently, connected miscellaneous petition stands closed.
