O R D E R

This writ petition is filed for the following relief:

“To call for the records relating to the order of rejection dated 15^th July 2024 passed by the 2^nd respondent rejecting the petitioner’s application made in Application No.TN-3202407153068, for issuance of Nativity Certificate and quash the same, and consequently direct the respondents to issue the Nativity Certificate to the petitioner within a time frame to be stipulated by this Court.”

The case of the petitioner is that she is the daughter of parents who are undisputed natives of Tamil Nadu by birth, belonging to a Backward Community, with continuous ancestral lineage and permanent residence in the State of Tamil Nadu, particularly in Kancheepuram District. The petitioner would submit that both her parents were educated in Chennai and possess valid Government records establishing their nativity and permanent residence in Tamil Nadu.

3. The petitioner would submit that due to her father’s overseas employment, the petitioner was born and educated in Sharjah, UAE. However, such a temporary residence abroad would not alter the petitioner’s right to claim Tamil Nadu nativity certificate, especially when both parents are natives of Tamil Nadu and the family’s permanent residence has always remained within the State.

The petitioner would further submit that she is a medical aspirant and had applied for a Nativity Certificate on 16.07.2024, for the purpose of appearing in the NEET examination and seeking admission under the Tamil Nadu State quota. The said application was arbitrarily rejected on the erroneous ground that the petitioner was not a resident of Tamil Nadu. Therefore, the petitioner would before this Court.

5. Heard the learned counsels on the either side and perused the records.

6. The status of the application would read as follows:

“Status : Send back to Kiosk / Citizen”

7. However, according to the 2^nd respondent, the application has been forwarded to the Revenue Inspector for enquiry about the residence of the applicant. Therefore, after receipt of the report of the Revenue Inspector, further orders have to be passed by the 2^nd respondent.

8. Therefore, the impugned order is quashed and the 2^nd respondent is directed to retain the application and pass orders, within a period of 2 weeks from the date of receipt of the report from the Revenue Inspector.

9. With the above direction, this writ petition is disposed of.

Consequently, the connected miscellaneous petition is closed. No costs.
