Prayer: This petition is filed under Section 483(1) (b) and 528 of BNSS, seeking to Modify the condition No.1 that the Petitioner/Accused-1 Shall execute a bond for Rs.15,000/- along with two sureties for like sum by each and one surety shall be a blood relative to the satisfaction of this court imposed in order dated 12.01.2026 in Crl.M.P.No.52/2025 in S.C.No.419/024 on the file of IV Additional District Judge, Tiruvallur at Ponneri, by permitting the petitioner to give a simple bond/sureties instead one surety shall be a blood relative, and allowing sureties with Aadhar, Voter ID, or income certificate.

ORDER

This Criminal Original Petition has been filed to modify the condition imposed by the learned IV Additional District Judge, Tiruvallur at Ponneri, in Crl.M.P.No.52/2025 dated 12.01.2026.

2. The learned counsel for the petitioner submitted that the petitioner is an innocent and the learned IV Additional District Judge, Tiruvallur at Ponneri while granting bail to the petitioner in Crl.M.P.No.52/2025 dated 12.01.2026, directed him to execute a bond for a sum of Rs.15,000/- along with two sureties for a like sum by each to the satisfaction of this Court among them one must be his blood relative. He submits that the petitioner does not have any blood relative who is ready and willing to stand as surety. Due to strained family circumstances and financial constraints, he was unable to comply with the aforesaid conditions. Hence, he has filed the present modification petition.

3. Heard the learned Government Advocate (Criminal Side) appearing for the respondent police.

4. Considering the facts and circumstances of the case and that reasons stated in the modification petition is acceptable, this Court is inclined to modify the condition to the effect that the petitioner is ordered to be enlarged on bail on executing a bond for a sum of Rs.15,000/- with two sureties for a like sum each to the satisfaction of this Court. The other conditions imposed by the lower Court shall remain intact. It is made clear that, furnishing solvency certificate is not necessary to execute the bond as directed.

5. With the above modification, this Criminal Original Petition is ordered.
