Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 3rd and 4th respondent to construct a concrete wall on the western side of petitioners property at the end of the check dam proposed to be constructed across Nagavathi river for the purpose of preventing excess waterflow in the agricultural land belongs to the petitioner by disposing of the petitioners representation dated 15.12.2025 and the same within a time to be stipulated by this Honourable Court.

ORDER
This Writ Petition has been filed for the following reliefs:-
“directing the 3rd and 4th respondent to construct a concrete wall on the western side of petitioners property at the end of the check dam proposed to be constructed across Nagavathi river for the purpose of preventing excess waterflow in the agricultural land belongs to the petitioner by disposing of the petitioners representation dated 15.12.2025 and the same within a time to be stipulated by this Honourable Court.”
2. A report has been submitted by the Assistant Engineer, WRD, Irrigation Section, Pennagaram which is signed on 02.02.2026, stating that as per the approved design, the petitioner’s land will not be prone to backwater effect or flooding. However, as a precautionary measure, earthen bunds will be provided on either side of the check dam, which, according to the Engineer, will safeguard the petitioner’s land.
3. The said report is taken on file and the Writ Petition is disposed of in terms of the said report. It is needless to state that if any damage is caused despite the measures taken, the State shall ensure adequate compensation to the petitioner. No costs.
