O R D E R

This writ petition is filed for the following relief:

“To direct the respondents to consider the petitioner’s representation dated 29.11.2025 and consequently direct the respondents not to grant any layout approval within the prohibited distance of 300 m from the petitioner's stone quarry comprising in Survey Nos.617/1 and 618 of Madukkarai Village, Madukkarai Taluk, Coimbatore District, in violation of the Tamil Nadu Minor Mineral Concession Rules, 1959.”

The petitioner would submit that she is carrying on business of Rough Stone and Gravel Quarry at S.F.Nos. 617/1 (0.38.0 Ha) and 618 (0.43.0 Ha) of Madukkarai Village, Madukkarai Taluk, Coimbatore District, over an extent of 0.810 Ha, since 2009, with prior and proper permissions and approvals from the competent authorities /

departments without any default.

3. The case of the petitioner is that in gross violation of Rule 36 (1-A) (C) of the Tamil Nadu Minor Mineral Concession Rules, 1959, adjacent land owners in S.F.No.610 of Madukkarai Village, Madukkarai Taluk, are attempting to form a layout located within the prohibited distance of 300 m from the existing petitioner's quarry, which is also in violation of orders of this Court dated 02.11.2020 in WP Nos. 23248 of 2020 etc., batch.

Therefore, the petitioner made a representation to the respondents on 29.11.2025, submitting objection and seeking not to grant any permission for the unauthorized layout proposed to be developed within the prohibited distance of 300 m from the petitioner's quarry. However, the same has not been acknowledged or any action taken till date. Hence, the present writ petition.

5. Considering the facts and circumstances of the case and considering the fact that the petitioner’s representation dated 29.11.2025 has not been considered till date, the respondents are directed to consider the same and pass orders on merits and in accordance with law within a period of 1 month from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is allowed.

Consequently, the connected miscellaneous petition is closed. No costs.
