PRAYER: Criminal Original Petition is filed under Section 528 of

BNSS, 2023, to direct the 1st respondent to transfer the investigation in

connection with the Crime No. 267 of 2025 dated 04.07.2025 on the file

of the 3rd respondent to any other competent investigation agency within

the time frame that may be stipulated by this Court by considering the

petitioner's representation dated 06.10.2025.

ORDER

Seeking to transfer the investigation in Crime No.267 of 2025

dated 04.07.2025 from the file of the third respondent Police to any other

competent investigating agency, this criminal orgiainal petition is filed.

2.The learned counsel for the petitioner submitted that the

petitioner is the defacto complainant and her daughter was subjected to

continuous and systematic dowry harassment by her husband and his

family. They also physically and mentally abused her, which ultimately

led her suicide. In this regard, a complaint was lodged by the petitioner,

following which, Crime No.267 of 2025 was registered by the third

respondent police for the offence under Section 194(3)(i) of BNSS, 2023.

Since there is no progress in the investigation, the present petitioner has

been filed.

3.The learned Government Advocate (Crl.side), on instructions,

submitted that after registering the FIR, postmortem certificate was

obtained by the police and awaiting for medical analysis. The

petitioner’s daughter committed suicide in her matrimonial house. The

marriage of the defacto complainant's daughter was love marriage and it

is stated that after the marriage, the petitioner’s daughter and her husband

lived in separate house, at the time when she committed suicide. She

wrote suicide note would reveal that 'No one should be held responsible

for her death'. Neighbours as well as relatives stated that ther is no

harassment and they were living happily. He also fairly submitted that

after obtaining viscera report, Section would be altered.

4.Heard the learned counsel on either side and carefully perused

the materials available on record.

5.The learned Government Advocate placed before me a copy of

suicide note, which is supposed to have been written by the deceased,

daughter of the petitioner. In this regard, the third respondent police is

directed to send the said handwritten suicide note for expert opinion to

ascertain whether the same matches the handwriting of the deceased girl.

It is also brought to the notice of this Court by the learned Government

Advocate that the viscera report is still awaited. The third respondent

police is directed to conclude the investigation, as expeditiously as

possible, preferably, within the period of three months from the date of

receipt of copy of this order and also directed to appraise the progress in

the investigation to the first respondent from time to time every Friday

and the first respondent is directed to monitor the ongoing investigation

which is being conducted by the third respondent. The petitioner is

directed to give copy of the genuine handwriting of her daughter so as to

enable verification of the genuineness of the suicide note, which has been
