ORDER

This Writ Petition has been filed seeking quashment of the entire records relating to the impugned order passed by the 1st Respondent in his proceedings in Na.Ka. 2563 / 2024 / Po.Pa.Ni.Ku dated 29.01.2025 and quash the same and consequently, directing the respondents to reinstate the petitioner into service with back wages, attendant benefit and other monetary benefits.

2. Mr.E.P.Senniyangiri, learned Government Advocate takes notice on behalf of the respondents 2 and 3. Mr.S.Ravikumar, learned Special Government Pleader takes notice on behalf of the respondents 2 and 3, and Mr.R.Bharanidharan, learned counsel takes notice on behalf of the first respondent. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that she was appointed as Clerk in the concerned Primary Agricultural Cooperative Credit Society in the year 1994. Thereafter, she was promoted as Senior Clerk in 2008 and subsequently, promoted as Secretary on 01.07.2020 and transferred to the second respondent society. After joining duty as Secretary, her pay scale was not fixed properly and salary was not disbursed accordingly. While she was discharging her duties in the second respondent society, she was placed under suspension on 26.07.2024 for a period of three months and charges were framed. However, subsistence allowance was not paid to her. Thereafter, without formally revoking the earlier suspension, she was transferred to the third respondent society and directed to join duty. Subsequently, vide proceedings in Na.Ka.No.2563/2024/Po.Pa.No.Ku, dated 29.01.2025, the first respondent once again placed the petitioner under suspension. Even thereafter, subsistence allowance was not paid. Though charge memo was issued and enquiry proceedings were initiated, no final order has been passed and subsistence allowance has not been disbursed. Aggrieved by the impugned suspension order dated 29.01.2025 and the continued non payment of subsistence allowance, the petitioner has filed the present Writ Petition.
