ORDER

This writ petition has been filed to direct the respondent to issue the patta to the property situated in the layout Bhuvaneshwari Nagar bearing Survey No. 142/3 comprising Eastern portion of Plot No. 34 and western portion of Plot No. 33 at Nerkundram Village, Ambattur Taluk, Tiruvallur District (Now Chennai) to the extent of 390 Sq.ft without insisting No Objection Certificate from the second respondent by considering the petitioners application for patta dated

02.08.2022.

When this matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents would submit that the present case has been filed for issuance of patta for the subject land. During an earlier occasion, a writ petition in WP.No.34800 of 2022 came to be filed for very same issue pertaining to very same subject property. The said petition was dismissed by this Court, vide a detailed order dated 07.06.2023, whereby, it was held that no patta can be issued to the petitioners therein.

3. Hence, he would submit that the issue involved in this case was already covered by the aforesaid order dated 07.06.2023 passed by this Court in WP.No.34800 of 2022 and thus, prays for dismissal of this petition.

4. Upon perusing the aforesaid order dated 07.06.2023 passed in WP.No.34800 of 2022 , it appears that this Court had elaborately discussed and held that the entire property belongs to Tamil Nadu Housing Board. As rightly submitted by the respondent, the said order will squarely be applicable to the present case.

5. Therefore, following the above order dated 07.06.2023 passed in WP.No.34800 of 2022 , this Court is inclined to dismiss the present petition.

Accordingly, this petition is dismissed. No cost.
