The court may direct the expediting of an investigation and mandate a monitoring mechanism by superior officers when a petitioner alleges lack of progress, as an alternative to transferring the investigation to another agency.

Headnote:The petitioner filed a petition under Section 528 of BNSS, 2023, seeking the transfer of investigation in Crime No. 7 of 2022 from the Economic Offences Wing (EOW) to the CBI. The case involves a money dispute with FIR registered for offences under Sections 120(b), 406, 420, 468, and 471 of the IPC. The petitioner alleged that there had been no progress in the investigation since the FIR was filed on 23.08.2022. The primary issue was whether the investigation should be transferred to the CBI due to the lack of progress.
