The present writ petition has been filed to direct the respondents 1 to 3 to remove the encroachment made by the respondents 4 to 6 by constructing the installation of barbed wire fencing and the construction of a toilet, tin-sheeted roof and stone pillars on the common pathway lane in Survey No. 425/1, classified as Government Natham Poromboke land, situated at Gopalapuram Village, Vembakottai Taluk, Virudhunagar District, by considering the petitioner’s representations dated 23.09.2025 and 21.01.2026.
2. It is the grievance of the petitioner that the respondents 4 to 6 have encroached upon the public pathway. In this regard, the petitioner has given representations dated 23.09.2025 and 21.01.2026. However, no further action has been taken.
3. Since the petitioner alleged that there are encroachments in the public pathway, this Court is of the view that the third respondent shall consider the representations of the petitioner and conduct a survey. If any encroachments are found in the public pathway, the same shall be removed after following due process of law. Such exercise shall be completed within three months from today.
4. With the said observations, this Writ Petition is disposed of. No costs.
