2026 Supreme(Online)(Mad) 23341

IN THE HIGH COURT OF JUDICATURE AT MADRAS
N.SATHISH KUMAR, M.JOTHIRAMAN, JJ
P.Radhakrishnan – Appellant
Versus
1. The District Collector, District Collector's Office, Sivagangai District 630 562. – Respondent
W.P.(MD)No.1326 of 2026

Advocates:
For the Appellants/Petitioners: Mr.K.Vasantha Kumar
For the Respondents: Mr.D.Sasikumar, Addl. Govt. Pleader for R1 to R5

The court determined that existing actions by authorities rendered the Writ Petition unnecessary, leading to dismissal.

Headnote:The Writ Petition under Article 226 of the Constitution seeks a Mandamus directing the removal of illegal constructions on specific survey numbers, pursuant to a prior directive from a government official. The Court noted that there was already a sealing of the constructions by authorities due to deviations from approved plans. Thus, it found no further direction necessary and dismissed the Petition. The primary issue framed was whether the authorities provided sufficient remedy for the alleged illegal constructions. The Court reasoned that the existing actions taken by the authorities rendered the Writ Petition unnecessary. Therefore, this Writ Petition is dismissed.
